1. Introduction & Agreement
Welcome to OMG Academy (“we”, “us”, “our”), a digital marketing education platform operated by OMG Academy Pty Ltd and backed by Online Marketing Gurus, Australia’s leading digital marketing agency.
By accessing our website at theomgacademy.com.au, enrolling in any course, or joining our community (“the Platform”), you (“Member”, “you”, “your”) agree to be bound by these Terms & Conditions in full. If you do not agree with any part of these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and OMG Academy. We recommend you read them carefully and retain a copy for your records.
2. Membership & Subscription
2.1 Subscription Plan
OMG Academy operates on a monthly subscription model. By enrolling, you agree to pay a recurring monthly fee of AUD $499.00 (inclusive of GST where applicable) in exchange for access to course content, learning resources, and the OMG Academy community.
2.2 Automatic Direct Debit
By subscribing, you authorise OMG Academy to automatically debit your nominated payment method on a recurring monthly basis. Payments will be processed on the same date each month corresponding to your original enrollment date. It is your responsibility to ensure your payment details remain current and that sufficient funds are available.
If a payment fails, we reserve the right to suspend or terminate your access to the Platform until the outstanding balance is resolved. We may make reasonable attempts to retry failed payments before suspension.
2.3 Pricing Changes
OMG Academy reserves the right to adjust subscription pricing. We will provide a minimum of 30 days’ written notice via email prior to any price change taking effect. Your continued use of the Platform after the effective date of any price change constitutes acceptance of the new pricing.
3. Cancellation Policy
3.1 How to Cancel
You may cancel your subscription at any time by sending a written cancellation request to:

Please include your full name, registered email address, and a clear request to cancel your membership. Cancellation requests must be submitted via email — verbal or informal requests will not be accepted.
3.2 Effective Date of Cancellation
Upon receipt and confirmation of your cancellation request, your subscription will remain active until the end of your current billing cycle. You will not be charged for any subsequent billing periods after the cancellation takes effect. No partial refunds will be issued for unused time within an active billing period.
3.3 Refund Policy
Subscription fees are non-refundable except where required by Australian Consumer Law. If you believe you are entitled to a refund under applicable law, please contact us at [email protected] with full details of your circumstances.
Once-off payments for digital courses, private workshops, consultations, auditing, or any other agreed and paid once-off costs, are strictly non-refundable and shall not be subject to reimbursement under any circumstances.
Deposits remitted in respect of forthcoming group workshops shall be refundable only where a written request for refund is received no later than forty-five (45) days prior to the scheduled workshop date; any refund request received thereafter shall be deemed void, and such deposits shall be forfeited and rendered non-refundable in their entirety.
4. Community Standards & Code of Conduct
OMG Academy’s community is a professional learning environment. All members are expected to engage respectfully, constructively, and in good faith. By joining the community, you agree to abide by the following standards:
4.1 Respectful Conduct
All members must treat fellow members, instructors, and OMG Academy staff with courtesy and respect. This includes:
- Engaging in constructive, professional dialogue at all times
- Acknowledging and respecting diverse perspectives, backgrounds, and experience levels
- Providing feedback in a helpful and considerate manner
- Refraining from personal attacks, insults, or inflammatory remarks directed at any individual or group
4.2 Prohibited Language & Harassment
The following are strictly prohibited within the OMG Academy community and platform:
- The use of profane, obscene, vulgar, or otherwise offensive language
- Harassment, bullying, intimidation, or threatening behaviour of any kind
- Discriminatory language or conduct based on race, gender, age, religion, sexual orientation, disability, or any other protected characteristic
- Sharing content that is defamatory, misleading, or harmful to others
Any member found to be engaging in harassment or abusive behaviour will be subject to immediate removal from the Platform without notice or refund.
4.3 No Self-Promotion or Solicitation
The OMG Academy community is designed exclusively for learning and peer support. Accordingly, the following activities are strictly prohibited:
- Promoting, advertising, or marketing your own products, services, or business offerings
- Soliciting other members for paid work, partnerships, or referrals without prior written approval from OMG Academy
- Posting affiliate links, spam, or unsolicited commercial content
- Recruiting other members to third-party platforms, communities, or businesses
Members who wish to discuss their own work in a learning context (e.g. sharing a live campaign for feedback) may do so, provided it is clearly educational in intent and not promotional in nature.
5. Access Rights & Termination
5.1 Licence to Access
Upon payment of the applicable subscription fee, OMG Academy grants you a limited, non-exclusive, non-transferable licence to access and use course content and community features for your own personal or internal business education purposes. This licence does not include any right to reproduce, distribute, resell, or commercially exploit any content on the Platform.
5.2 OMG Academy’s Right to Remove Access
OMG Academy reserves the right, in its sole and absolute discretion, to suspend, restrict, or permanently terminate your access to any or all features of the Platform — including courses and community — at any time and without prior notice, for any reason including but not limited to:
- Breach of these Terms & Conditions
- Conduct that OMG Academy deems harmful, disruptive, or contrary to the interests of the community
- Non-payment or repeated payment failures
- Any behaviour that OMG Academy considers to be damaging to its reputation or the integrity of the Platform
In circumstances where access is terminated due to a breach of these Terms, no refund will be issued for any unused portion of your subscription period.
5.3 Account Responsibility
Your account is personal to you and must not be shared with or transferred to any third party. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
6. Intellectual Property
All content on the Platform — including but not limited to course videos, written materials, frameworks, workbooks, templates, and branding — is the intellectual property of OMG Academy and its licensors. Nothing in these Terms grants you any right to use OMG Academy’s intellectual property beyond the limited access licence described in Section 5.1.
You must not record, screenshot, copy, distribute, or reproduce any Platform content without prior written consent from OMG Academy.
7. Disclaimer & Limitation of Liability
OMG Academy provides educational content for informational purposes only. While we strive to ensure all course content is accurate, current, and of high quality, we make no representations or warranties — express or implied — regarding the outcomes or results you may achieve from applying the strategies and information provided.
To the maximum extent permitted by law, OMG Academy’s total liability to you for any loss or damage arising from your use of the Platform shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by agreement.
8. Privacy
OMG Academy collects and handles personal information in accordance with its Privacy Policy, available at theomgacademy.com.au. By using the Platform, you consent to the collection and use of your information as described in that policy.
9. Changes to These Terms
OMG Academy reserves the right to update or modify these Terms & Conditions at any time. Where changes are material, we will notify you via email at least 14 days prior to the changes taking effect. Your continued use of the Platform after that date constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
